1. Introduction

Welcome to DatumIQ ("we", "our", and "us"). These Terms of Service ("Terms") govern your access to and use of our cloud-based analytics platform and web application located at www.app.datumiq.ai (the "Service"). By accessing or using the Service, you and the entity you represent ("Customer") agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Use of the Service

2.1 Commercial License: Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to access the Service via a web browser for your internal business purposes only.

2.2 Access Control: Access is restricted to authorized users via unique Organization Activation Codes. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account.

2.3 Prohibited Conduct: You agree not to:

Attempt to reverse-engineer, decompile, or bypass the security of the web application.
Use any automated system (crawlers, scrapers) to extract data from the Service.
Interfere with the proper working of our network or database layers.
3. Data Security and Privacy

3.1 Data Ownership: You retain all rights, title, and interest in and to the data you connect or upload to the Service ("Customer Data"). You grant DatumIQ a limited license to process this data solely to provide analytics and insights.

3.2 Security Architecture: We maintain industry-standard administrative and technical safeguards, including:

Network Layer: Protection via Cloudflare DNS proxy and WAF, with mandatory TLS 1.3 encryption in transit.
Database Layer: Logical isolation of Customer Data via Supabase Row Level Security (RLS) and encryption at rest using AES-256.
Access Reviews: Regular auditing of administrative access to production environments.
3.3 Privacy: Your use of the Service is also governed by our Privacy Policy, available at datumiq.ai/privcy-policy.

4. AI and Data Usage

4.1 No Model Training: DatumIQ utilizes artificial intelligence to provide strategic recommendations. We do not use Customer Data to train, improve, or fine-tune our global foundation models. Your data is used exclusively to generate insights for your specific organization.

4.2 Decision Support: The Service provides automated insights for informational purposes. The Customer is solely responsible for any business decisions, strategies, or actions taken based on the output of the Service.

5. Intellectual Property

All rights, title, and interest in the Service—including the web interface, proprietary algorithms, recommendation engines, and "look and feel"—remain the exclusive property of DatumIQ.

6. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the web application will be uninterrupted, error-free, or completely secure from all third-party interference.

7. Limitation of Liability

To the fullest extent permitted by law, DatumIQ’s total aggregate liability for all claims arising out of or related to these Terms shall not exceed the total amount paid by Customer to DatumIQ during the twelve (12) months immediately preceding the event giving rise to the claim. We shall not be liable for any loss of profits, data, or indirect, consequential, or punitive damages.

8. Termination

We reserve the right to suspend or terminate your access to the web platform if you breach these Terms or if your organization's subscription ends. Upon termination, your right to access the web interface will immediately cease.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Wilmington, DE, without regard to its conflict of law provisions.
